These Website Terms of Use ("Terms") govern your access to and use of Cartful's public website and any content, materials, and features made available on it (the "Website"). By accessing or using the Website, you agree to these Terms.
If you do not agree, do not use the Website.
1) Relationship to customer agreements
Cartful Studio and any paid services are provided only under a written agreement (for example, a Statement of Work and Master Services Agreement, together a "Customer Agreement").
If you have a Customer Agreement with Cartful, that Customer Agreement governs your use of Cartful's services. These Terms govern only your use of the Website and do not replace or modify a Customer Agreement. If there is a conflict between these Terms and a Customer Agreement, the Customer Agreement controls for the services it covers.
2) Privacy
Cartful's collection and use of personal information through the Website is described in our Privacy Policy and Cookie Policy. By using the Website, you consent to those practices.
3) Permitted use and restrictions
You may use the Website only for lawful purposes and in accordance with these Terms.
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Website or its content except as expressly permitted by Cartful in writing.
- Reverse engineer, decompile, or attempt to extract source code or underlying ideas from the Website except to the extent such restriction is prohibited by law.
- Access the Website through automated means (including bots, scrapers, or crawlers) in a way that imposes an unreasonable load, bypasses access controls, or copies content for competitive or commercial use.
- Interfere with the Website's operation or security, including by probing, scanning, or testing vulnerabilities, except as expressly permitted under Cartful's Responsible Disclosure Policy.
- Upload or transmit malware, harmful code, or anything designed to disrupt the Website.
- Use the Website to send unsolicited communications or to impersonate any person or entity.
Cartful may suspend or block access to the Website at any time if we believe your use violates these Terms or creates risk for Cartful, the Website, or others.
4) Intellectual property
The Website and all content on it (including text, graphics, logos, product names, designs, and software) are owned by Cartful or its licensors and are protected by intellectual property laws.
Cartful grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your internal business purposes. No other rights are granted.

8) Limitation of liability
To the maximum extent permitted by law:
- Cartful will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of the Website.
- Cartful's total liability for any claims arising out of or related to the Website or these Terms will not exceed $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
9) Governing law and venue
These Terms are governed by the laws of the State of New York, excluding its conflict of laws rules.
Any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction and venue in those courts.
10) Changes to these Terms
Cartful may update these Terms from time to time by posting an updated version on the Website with a new "Last updated" date. Your continued use of the Website after the update means you accept the updated Terms.
